With a few weeks of work under the belt after a break, here’s a quick refresher on changes to Employment Law in 2019 and look ahead to what could lie in 2020.
Cashing-up Annual Holidays
It’s not all that common but Employees can ask their employer to pay out in cash instead of taking a holiday for up to one week of their four weeks’ minimum entitlement to annual holidays per year, for each entitlement year. They can do this all at once, or can make multiple requests to cash-up until the entire one week is cashed up.
Significant Changes to Trust Law
A new Trusts Act 2019 will come into effect in January 2021 and will be the most comprehensive overhaul of New Zealand’s Trust law in more than 60 years.
A significant number of our clients have Family Trusts and there is now a window of opportunity of 14 months to review these Trusts.
What is Relationship Property?
The Property (Relationships) Act 1976 sets out the law for division of ‘relationship property’ following division of a marriage, civil union or de facto relationship. A de facto relationship is simply a relationship - irrespective of the sex of either person - where the two people are 18 or older and live together as a couple
